These terms cover use of this direct-booking site and short-term rental reservations with Lowcountry Stays in Mount Pleasant, South Carolina and the Lowcountry.
These Terms of Service govern your use of Lowcountry Stays's website and direct-book short-term rental services. By using the site, submitting a booking request, signing a rental agreement, or completing payment, you agree to these Terms.
If you do not agree, do not use the site or complete a booking.
You must be at least 18 years old and legally able to enter into a binding agreement to use the direct-booking services.
Lowcountry Stays may act as host, property manager, booking operator, or authorized agent for listings shown on the site. The specific property, stay dates, charges, rules, and host obligations for a reservation are identified in the listing, checkout flow, confirmation, and signed rental agreement.
A reservation is not confirmed until payment is successfully processed and you receive confirmation from us. Availability, rates, taxes, fees, cleaning charges, minimum stays, and house rules may vary by listing and date.
We may decline or cancel a booking request when dates are unavailable, required information is missing, payment fails, identity verification cannot be completed, the booking appears fraudulent, or the reservation would violate these Terms, the rental agreement, local rules, or property requirements.
Rates, fees, taxes, and availability may change until a reservation is confirmed. Obvious pricing, availability, or listing errors may be corrected, and we may cancel or adjust an affected booking where permitted by law.
You agree to provide accurate name, email, phone, guest count, stay dates, payment, and identity verification information. You are responsible for keeping booking information current and for communicating any changes promptly.
The person completing the booking must be authorized to enter into the rental agreement and is responsible for all guests and invitees during the stay.
Payment is processed securely through Stripe. Prices shown at checkout may include nightly rates, cleaning fees, processing fees, South Carolina accommodations taxes, and applicable local taxes or fees.
You authorize us and our payment processor to charge the payment method provided for the booking total, approved extensions, damage, missing items, excessive cleaning, rule violations, late check-out charges, cancellation charges, and other amounts allowed by the rental agreement or these Terms.
You agree not to make a false or improper payment dispute. If you initiate a chargeback or payment dispute, we may provide booking records, communications, identity verification records, signed agreements, and stay details to Stripe, banks, card networks, advisors, or other parties involved in resolving the dispute.
Each direct booking requires acceptance of a short-term rental agreement. The agreement includes stay-specific details such as the property, dates, guest count, payment summary, rules, electronic signature, and governing law.
If these Terms conflict with a signed rental agreement for a specific stay, the signed rental agreement controls for that stay.
Guests must follow the listing's house rules, posted instructions, check-in and check-out requirements, parking rules, occupancy limits, quiet hours, and all applicable laws and ordinances.
Unless we approve otherwise in writing, smoking, parties, events, illegal activity, unauthorized pets, and disruptive behavior are not permitted. Violations may result in additional charges, cancellation, removal from the property, and loss of refund eligibility.
You are responsible for the conduct of all guests, visitors, invitees, and anyone you allow onto the property during the stay.
Guests must respect neighbors and comply with Town of Mount Pleasant and South Carolina rules that apply to short-term stays, including noise, parking, occupancy, safety, and tax-related requirements.
We may provide information needed to comply with lawful government requests, tax obligations, permitting, code enforcement, or dispute resolution.
Cancellation and refund terms are those shown during booking or in your rental agreement. Refund timing may depend on Stripe, your bank, card network rules, and any deductions or disputes that apply.
We are not responsible for weather, travel delays, illness, road closures, utility interruptions, area events, or other circumstances outside our control except where a refund is expressly required by the booking terms or applicable law.
Travel insurance is recommended if you want protection for unexpected events, interruptions, medical issues, weather, transportation problems, or other circumstances that may affect your trip.
You are responsible for damage, missing items, excessive cleaning, unauthorized guests or pets, smoking remediation, fines, and costs caused by you or your guests beyond ordinary wear and tear.
Please report issues promptly during your stay so we have a fair opportunity to help.
We may document property condition before, during, or after a stay and may use invoices, photos, messages, cleaner reports, repair records, and other reasonable evidence to support charges or claims.
You agree to use the property safely and responsibly, promptly report hazards or maintenance issues, and follow posted safety instructions. You may not tamper with smoke detectors, carbon monoxide detectors, locks, cameras, network equipment, utilities, or safety devices.
We or our authorized representatives may access the property when reasonably necessary for emergencies, safety, repairs, inspections, suspected rule violations, legal compliance, or to protect the property. We will provide reasonable notice when practical.
Photos, descriptions, rates, amenities, maps, and availability are provided in good faith and may change. We work to keep information accurate, but minor differences may exist between site content and the current condition of a property.
You may not copy, scrape, reproduce, or misuse site content, logos, photos, booking flows, or software except as allowed by law.
Our Privacy Policy explains how we collect, use, and share information. By using the site or booking a stay, you also agree to the Privacy Policy.
The site is provided on an as-available basis. To the fullest extent permitted by law, we disclaim warranties not expressly stated in these Terms or a signed rental agreement.
To the fullest extent permitted by law, our liability for claims related to the site or a stay is limited to the amount you paid us for the booking giving rise to the claim. This limitation does not apply where prohibited by law.
We are not responsible for indirect, incidental, consequential, special, exemplary, or punitive damages, or for losses caused by third-party services, guest conduct, events outside our reasonable control, or your failure to follow these Terms, house rules, posted instructions, or applicable law.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the host, property owner, property manager, and their agents from claims, losses, liabilities, damages, fines, penalties, costs, and expenses arising from your breach of these Terms, your stay, your guests or invitees, property damage, personal injury, illegal activity, or violation of law, except to the extent caused by the indemnified party's gross negligence or willful misconduct.
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules. Venue for disputes will be in the state or federal courts located in Charleston County, South Carolina, unless applicable law requires otherwise.
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the site or services after updates means you accept the updated Terms.
